Terms of Service

Welcome to Wheres Whiskey. By accessing or using our website at whereswhiskey.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 21 years of age to create an account and use account features of this Service. By creating an account, you represent and warrant that you meet this age requirement. We rely on self-attestation during signup and do not independently verify your age.

2. Account Registration

• You must provide a valid email address and create a password to register.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate information and to keep your email address current.
• One account per person. Duplicate accounts may be terminated.

3. The Service

Wheres Whiskey monitors publicly available Oregon liquor store inventory data and sends email notifications ("alerts") when selected bottles appear in selected cities.

• The Service is provided on an "as is" and "as available" basis.
• We do not guarantee that a bottle will still be in stock when you receive an alert or visit the store.
• Chance to Purchase lottery statistics and odds are provided for informational purposes only and do not guarantee selection in any lottery.

4. Data Accuracy

All inventory data, bottle availability, store details, and lottery statistics displayed by this Service are sourced from publicly available third-party systems. We do not control, operate, or independently verify these data sources.

This data may be inaccurate, incomplete, delayed, or outdated at any time. Discrepancies between the data shown on this site and actual in-store availability are common and are outside of our control. Possible causes include, but are not limited to:

• Delays between when a store receives or sells inventory and when upstream systems reflect the change.
• Errors or omissions in the underlying public data.
• Temporary outages or inconsistencies in the third-party systems we rely on.
• Stores reserving inventory for specific buyers before it appears publicly available.

You should not rely solely on this Service when making purchasing decisions. We strongly recommend confirming availability directly with the store before visiting. Wheres Whiskey assumes no responsibility for losses, wasted trips, or missed purchases resulting from data inaccuracies.

5. OLCC Disclaimer

Wheres Whiskey is not affiliated with, endorsed by, or sponsored by the Oregon Liquor & Cannabis Commission. All data is derived from publicly available information. References to OLCC programs (including Chance to Purchase) are for informational purposes only.

6. Subscription Plans & Billing

Free Tier

Every new account starts on the Free plan, which allows 1 alert subscription with up to 3 cities at no cost for 3 days after account creation. After 3 days, Free-tier alerts are paused - you will not receive notifications, and you cannot create or edit alerts. Your saved alerts are preserved and will reactivate if you upgrade to a paid plan.

Paid Plan (Pro)

• Pro ($5/month) - unlimited watchlists and alerts, Restock Predictions, Watchlist Search, store delivery dates, lottery notifications, and Feed.

Billing

• Paid subscriptions are billed through Stripe on a recurring monthly basis.
• By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.
• We may change subscription pricing with 30 days' notice. Price changes take effect at the start of your next billing cycle.

Cancellation & Refunds

• You may cancel your paid subscription at any time from your Billing page.
• Upon cancellation, your paid features remain active until the end of the current billing period. After that, your account reverts to the Free tier.
• No refunds are issued for partial billing periods, including if you cancel during a paid period or delete your account.

7. Acceptable Use

You agree not to:

• Use automated means (bots, scrapers, scripts) to access the Service.
• Share your account credentials with others or allow multiple people to use a single account.
• Resell, redistribute, or commercially exploit alerts or data from the Service.
• Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
• Use the Service for any unlawful purpose.

8. Intellectual Property

All content, design, and code on this website (excluding publicly sourced data and third-party libraries) is the property of Wheres Whiskey. You may not copy, modify, or distribute our content without prior written permission.

9. Account Termination

• You may delete your account at any time from your Account Settings page.
• If you have an active paid subscription at the time of deletion, it will be canceled immediately. No refund is issued for the remaining billing period.
• We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.
• Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OREGON LIQUOR ALERTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Wheres Whiskey and its operators from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Oregon.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Effective date" at the top of this page and may notify registered users by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
